Reverse Justice Odili led judgement of gross injustice against David Lyon, Degi-Eremienyo - Group urges CJN

    A human rights group under the aegis of Concerned Nigerians for Justice, Unity, Democracy and National Integration (CNJUDNI) has made a serious distress call to the Chief Justice of Nigeria, Justice Ibrahim Tanko Muhammad to reverse Justice Mary Odili led alleged judgement of gross injustice against the democratically Bayelsa Governor-Elect, Chief David Lyon and his Deputy, Senator Biobarakuma Degi-Eremienyo few hours to their  swearing-in,  in order to ensure justice and  protect the interest of the electorates to save democracy in the country.

   The Body made the call in a Press statement issued in Abuja yesterday  signed by Mac-Sampson Ahmed, it national Coordinator, following the unacceptable judgment that led to massive protest, destruction of properties in Bayelsa,  and many described the judgment led by Justice Mary Odili as political gimmick and a coup plot ahead of 2023 Presidential election.
    The Organization also called on the Supreme Court to upheld the judgement of the Court of Appeal three-man panel led by Justice Stephen Adah, that held that the Federal High Court judge, Justice Inyang Ekwo ,Abuja which was delivered   on November 12, 2019 that disqualified the APC governor-elect on the grounds that his deputy provided false information to INEC, erred in his decision disqualifying the APC’s deputy governorship candidate.

  According to the Judge“The appeal has merit and it is hereby allowed, the judgment of the lower court delivered on November 12, 2019 by Justice Inyang Ekwo is hereby set aside.

   Order is hereby made dismissing the suit of the respondents,” Justice Rilwan Abdullahi of the Court of Appeal who read the appellate court’s lead judgment, held.
    The Court of Appeal held that there were no enough grounds for the Federal High Court to rule the way it did, adding that the allegation that Degi-Eremienyo gave false information to INEC was not proved as required.
    It faulted the lower court’s reliance on section 31(5 and 6) of the Electoral Act in disqualifying the APC’s deputy governorship candidate.
    The court added that the allegations against Degi-Eremienyo required a proof beyond reasonable doubt.
    Justice Abdullahi insisted that the Peoples Democratic Party and its governorship candidate in the election, Douye Diri, and Lawrence Ewhruojakpo, who were the plaintiffs at the lower court and respondents at the Court of Appeal, failed to prove their allegations beyond reasonable doubt.

   Thus, the organization wondered why Justice Mary Odili who married to a Chieftain of the Peoples Democratic Party (PDP), former Governor Peter Odili of Rivers State will not step down, and still led a noxious, oppressive and deliberate judgment of gross injustice against the All Progressives Congress Candidate and his Deputy,  against the desire of the people of Bayelsa state not unconnected with an alleged fraudulent financial inducement as several workers and retirees in the state were not yet paid their December and January Salaries and pensions.

   It called on EFCC and the National Judicial Council to investigate on the matter and bring the perpetrators to book.
   The body described Senator Biobarakuma Degi-Eremienyo as a man of impeccable character, generous, educationally  sagacious and of exceptional exemplary leadership qualities and people –oriented, cannot involved himself on unfounded allegation of certificate forgery.
    The organization startle why Justice Odili led panel will impose forgery to an innocent education man of high esteem literally and orally.
  They appeal to the Supreme Court to have the fear of God and reverse what they described as cruel, oppressive and 2023 politically motivated judgment against the Bayelsa state All Progressives Congress (APC)  democratically Governor-Elect, Chief David Lyon and his Deputy, Senator Biobarakuma Degi-Eremienyo  to actualize the judiciary as the last hope of the common man.
  It added that the Supreme Court judgment led by Justice Mary Odili is unreasonable, unacceptable and inhuman; and further call to reverse the judgment in order to promote peace and social justice in the state to end the incessant dusk to dawn curfew in Bayelsa.
